Potential Conflict of Interest

Providers should be aware of a possible conflict of interest under Federal law (5 U.S.C. 5536) which prohibits medical personnel who are active duty Service members (ADSM) or civilian government employees from receiving compensation above their normal pay and allowances for medical care rendered.
It is important to note that claims for TRICARE services will deny if the services were provided by a Uniformed Service member moonlighting without authorization from the military. Claims could also deny if the beneficiary was referred to a specialist by a Uniformed Service member moonlighting without authorization from the military. This applies to TRICARE benefits whether the claim for reimbursement is filed by the individual who provided the care, the facility in which the care was rendered, or by the sponsor/beneficiary.
